Terms and Conditions

1. Acceptance of Terms

By using the Blueback Freediving & Yoga website (www.bluebackfreedivingandyoga.com) or booking our services, you agree to these Terms and Conditions and our Privacy Policy. If you do not agree, please do not use our website or services.

2. Services

Blueback Freediving & Yoga provides freediving and yoga courses, retreats, workshops, and training. All bookings are subject to availability and confirmation.

3. Bookings and Participation

All participants must complete our required registration forms and, when necessary, provide a signed medical history form and liability waiver before joining any course or event.
Participants must be fit to dive and confident swimmers for all in-water activities with us.
Bookings are confirmed when 1) Payment is received; and 2) All required administrative, health & safety forms have been received by us (including a Physician's letter and stamp of approval, if required to do so when completing the medical history form).
We reserve the right to refuse service or participation at our discretion, especially for safety or wellbeing.

4. Changes and Cancellations

By You:

If you wish to cancel or reschedule your booking, please notify us as early as possible.
We do not offer refunds once your booking and payment have been received*.

LEARN-TO-FREEDIVE COURSES:

We provide the option to reschedule your 'Learn-to-Freedive' course with us if you inform us no later than two weeks prior to the start date of your booked course. Please call us on 0439770038 to reschedule.
We do not provide rescheduling options within two weeks of the start of your course with us*, as we will have committed facility and staffing resources to your booked activity at that time.
Late arrivals, no-shows, or missing activities are not eligible for refunds.

SQUAD, CHARTERS, TRIPS & WORKSHOPS / SPECIALTY PROGRAMS:

For squad, charters, trips, workshops and specialty programs, there are specific terms and conditions that apply for changes and cancellations.

SQUAD

For squad booking changes or cancellations see the updated version of the Blueback Squad Safety Booklet and Form, a document found on our website (downloadable), accessed during the booking process for squad. it is a requirement to read the booklet prior to booking.
In short, choose your squad dates wisely as they are non-refundable and non-transferable. We recommend that you don't book for squad sessions until you're ready to commit to the booking as we are creating customized programs for every squad freediver session, immediately in response to the associated booking. Squad sessions are the result of 12-months of planning, programming, pre-booking facilities and staff based on confirmed bookings.

CHARTERS

For charter booking changes or cancellations, we accept no rescheduled charters and give no refunds if you're unable to attend.
The vessel and staff are booked 6-12 months ahead of the charter and we are committed to fees and charges associated with these bookings.
Charters may be transferable under certain conditions where you are unable to attend, if the person taking your booking: 1) Is a certified Freediver and can provide their certification on request; 2) completes and returns the registration and medical history form at least 24 hours prior to the charter and is fit to freedive; 3) has been given all the booking and charter information by you so they are duly informed of the charter program, safety expectations and venues which are provided to individual bookings through the confirmation email (which they will not have received through us); and 4) you have informed us of the change within 24 hours of the charter and it has been accepted; and 5) the new person taking your booking has contacted us with their email address and booking forms.

TRIPS

For trips, see the updated version of the program (housed online on the services or landing page for that trip) to be informed of the Terms and Conditions specific for that trip.

WORKSHOPS

For workshops, see the updated version of the workshop program (housed online on the services or landing page for that workshop, or in the FAQ at the bottom of the services or landing page for that workshop) to be informed of the Terms and Conditions specific for that workshop.

SPECIALTY PROGRAMS

For specialty programs, see the updated version of the specialty program brochure (housed online on the services or landing page for that specialty program, or in the FAQ at the bottom of the services or landing page for that specialty program) to be informed of the Terms and Conditions specific for that workshop.

By Us:

We may change dates, locations, or instructors if necessary due to weather, safety, or other unforeseen circumstances.
If we cancel, you can reschedule or request a refund for payments made for the affected booking.

* Extenuating circumstances outside of the prior knowledge and control of our clients (such as a serious health issue or family emergency) may be considered exceptions. If in doubt, please inform our office as soon as possible via text (0439770038) and via email (bluebackfreedivingandyoga@gmail.com). We take confidentiality seriously and are more apt to understand and support you when you are communicative from the beginning about any possible booking challenges.

5. Safety and Conduct

Safety is our top priority. Participants must follow all instructions from instructors or staff.
We reserve the right to remove any participant who acts in a manner that may endanger themselves or others, with no refund provided.

6. Pricing And Payment

All prices are shown in Australian Dollars and include GST (unless noted).
Payment is required as specified at booking. Bookings are only confirmed once payment is received.
Prices may be changed at any time, but confirmed bookings will not be affected.

7. Liability

To the maximum extent permitted by law, Blueback Freediving & Yoga and its staff are not liable for injuries, loss or damage incurred during activities, except where required by law.
Participation is at your own risk. Please consult a doctor if you have any medical concerns.

8. Intellectual Property

All materials, content, and branding on the website are owned by Blueback Freediving & Yoga. No images, logos, or text may be used or reproduced without written permission.

9. Privacy

We respect your privacy. See our Privacy Policy for details on how we collect, use, and protect your information.

10. Photos and Media

We may take photos or videos during courses or events for use in our marketing. If you do not wish to appear, please notify us in advance.

11. Amendments

These Terms may be updated at any time. Continued use after changes signifies acceptance.

12. Governing Law

These Terms are governed by the laws of Western Australia.
